Introduction

This Distance Sales Agreement is made between:

• BUYER: The individual or entity purchasing services from Tamrinotte.

Subject of The Agreement

This Agreement governs the remote sale of digital services, including but not limited to web development, mobile applications, technical support, and subscription-based services, provided by Tamrinotte to the Buyer through electronic communication.

Services & Pricing

• The services to be provided and their pricing will be determined individually through a separate offer or agreement between the Seller and the Buyer before payment.
• Prices may vary depending on the nature and scope of the services required by the Buyer. The Seller will provide a unique link containing payment details for the agreed-upon service.
• The final price includes all applicable taxes unless stated otherwise.

Payment & Invoicing

• Payment shall be made through the secure payment gateway provided by the Seller. Supported payment methods include credit/debit cards and third-party payment processors, including but not limited to Iyzico and Stripe.
• Upon receipt of payment, either a receipt or an invoice will be issued and sent electronically to the Buyer via email, depending on the nature of the transaction and in accordance with Turkish tax regulations.
• The Seller reserves the right to suspend or terminate services if payment is not received within the agreed period.
• The Buyer agrees to the specified payment terms before the commencement of services.

Delivery of Services

Service delivery is based on the agreed payment terms between the Buyer and Seller. The timeline and payment structure may vary on a case-by-case basis.

Cancellation & Refund Policy

• Since the services provided are digital and tailored to the specific needs of the Buyer, no refunds will be issued once the service has been initiated unless required by applicable laws.
• If the Buyer wishes to cancel before service delivery has commenced, a partial refund may be issued at the Seller’s discretion.

Liability & Warranty

• The Seller guarantees that the services provided will be performed with reasonable skill and care.
• The Seller is not responsible for issues caused by third-party software, hosting services, or external factors beyond their control.
• The maximum liability of the Seller under this Agreement shall not exceed the amount paid by the Buyer for the service.

Governing Law & Dispute Resolution

• This Agreement shall be governed by the laws of the Republic of Turkey, without regard to conflict of law principles.
• Any disputes arising from this Agreement shall be settled amicably. If an agreement cannot be reached, disputes shall be resolved in the courts of Turkey.
• If the Buyer is located outside Turkey, international arbitration may be considered upon mutual agreement.

Miscellaneous

• This Agreement does not restrict international sales, and the Buyer is responsible for compliance with their local regulations.
• This Agreement is subject to updates. Any modifications will be communicated to the Buyer before taking effect.
• By making a payment and using the services, the Buyer acknowledges that they have read, understood, and agreed to this Distance Sales Agreement.
